Auraly — Terms of Use

Welcome to Auraly. These Terms of Use ("Terms") govern your access to and use of the Auraly mobile application ("App" or "Service"), operated by Centaur Studios ("we," "us," or "our"). By downloading, accessing, or using Auraly, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction, whichever is higher) to create an account and use Auraly. By using the App, you represent and warrant that you meet this age requirement.
2. Account Registration
- You must provide accurate, complete, and current information when creating your account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately if you become aware of any unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. The Auraly Service
Auraly is a relationship companion app that provides couples with tools to strengthen their bond, including but not limited to:
- Couple pairing via unique Aura Link codes
- Shared dream boards and goal tracking
- Love notes between partners
- Wish lists and gift tracking
- Memory Wall for sharing photos and moments
- Daily couple questions
- Mood tracking
- Important date reminders
- Home design planning
4. User Content
4.1 Your Content
You retain full ownership of all content you create or upload through Auraly, including but not limited to photos, notes, dream entries, and answers to questions ("User Content").
4.2 License to Us
By submitting User Content, you grant us a limited, non-exclusive, royalty-free license to store, display, and transmit your content solely for the purpose of operating and providing the Auraly service to you and your paired partner. We will not use your content for any other purpose.
4.3 Content Responsibilities
You are solely responsible for your User Content. You agree not to upload, post, or share content that:
- Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
- Infringes any third party's intellectual property, privacy, or other rights.
- Contains malware, viruses, or any harmful code.
- Depicts the sexual exploitation of minors or any illegal activity.
4.4 Shared Couple Content
Content created within a couple space is visible to both paired partners. If you unpair from a partner, previously shared content may remain accessible to the other partner. You should exercise discretion when sharing content within the app.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to any part of the App, other accounts, or related systems.
- Interfere with or disrupt the integrity or performance of the App.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
- Use automated means (bots, scrapers, etc.) to access the App.
- Harass, abuse, or harm another person through the App.
- Create multiple accounts for abusive purposes.
- Impersonate another person or entity.
6. Pairing and Partner Connections
- Auraly allows you to connect ("pair") with another user using a unique pairing code ("Aura Link").
- You should only share your Aura Link with your intended partner.
- You are responsible for ensuring you pair with the correct person.
- We are not responsible for any interpersonal disputes arising from the use of the App.
7. Intellectual Property
All rights, title, and interest in and to the App (excluding your User Content), including but not limited to the design, code, graphics, logos, trademarks, and all related intellectual property, are and remain the exclusive property of Centaur Studios. These Terms do not grant you any rights to use our trademarks, logos, or branding without our prior written consent.
8. Third-Party Services
Auraly uses Google Firebase to provide authentication, database, and storage services. Your use of these services is also subject to Google's Terms of Service and Privacy Policy. We are not responsible for the practices of third-party service providers.
9. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
- Auraly is a relationship companion tool, not a licensed counseling or therapy service. It should not be used as a substitute for professional relationship counseling, therapy, or medical advice.
- We do not guarantee any specific outcomes from using the App.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CENTAUR STUDIOS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify, defend, and hold harmless Centaur Studios and its officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
- By You: You may stop using the App at any time. You can delete your account through the Settings screen in the App or by contacting us.
- By Us: We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice, including if we reasonably believe you have violated these Terms.
- Effect of Termination: Upon termination, your right to use the App ceases immediately. We may delete your data in accordance with our Privacy Policy. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Indemnification) will survive.
13. Modifications to the Service and Terms
- We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice.
- We may update these Terms from time to time. Material changes will be communicated through an in-app notice or other appropriate means.
- Your continued use of the App after changes to these Terms constitutes acceptance of the revised Terms.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the App shall be resolved through the courts of Istanbul, Turkey.
15. Severability
If any provision of these Terms is held to be unenforceable or invalid, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy and End User License Agreement (EULA), constitute the entire agreement between you and Centaur Studios regarding your use of the App.
